dotFM® & dotAM® TRADEMARK USAGE POLICY
 (effective August 6, 2002)

This Trademark Usage Policy will show you the proper use of dotFM® and dotAM® trademarks and logos. BRS Media, Inc. does require that you use our trademarks and registered trademarks correctly and refer to them properly. The terms of this section apply to the entire Corporate Identity Guide of BRS Media, Inc. located here: brsmedia.fm/trademark

Use of the trademark(s) by distributors, registrars, resellers and retailers with whom BRS Media has an ongoing commercial relationship for the purpose of selling .FM & .AM Domain Names requires prior consent and a formal license registrar agreement.
USE THE CORRECT SYMBOL
When using a dotFM® (or dotAM®) trademark in text form (“dotFM® Mark”) (“dotAM® Mark”) use the correct ® or ™ symbol, as indicated on the trademark chart below (The “dotFM®/dotAM® Mark Chart”), on the most prominent (or if none is prominent, the first) appearance of a dotFM® & dotAM® Mark.

The basic rule is if you are using a dotFM® Mark that is registered with the U.S. Patent & Trademark office the ® symbol should be displayed, and if the dotFM® Mark is not yet registered, the ™ symbol should be displayed. Once a dotFM® Mark is correctly attributed on a document or web page, it is not ordinarily necessary to mark subsequent appearances of the trademark in the piece. Every appearance of a dotFM® Mark in stylized form or design (“dotFM® Logo”) should also appear with the appropriate ® or ™ symbol, and may be used only under license from BRS Media, Inc.

ALWAYS USE dotFM MARKS AS PROPER ADJECTIVES
A trademark is an adjective and should not be used as a verb or noun or in the possessive or plural forms. Every dotFM® Mark has a “product descriptor” (i.e. a noun) that follows the trademark.

DO NOT ALTER dotFM® MARKS OR dotFM® LOGOS
When using a dotFM® Mark, never vary the spelling, add or delete hyphens, make one word two, or use a possessive or plural form of the dotFM® Mark. When using a dotFM® logo, never modify the design, add or delete any words, change any colors or proportions.

DO NOT ABBREVIATE A dotFM® MARK TO CREATE AN ACRONYM

FM instead of dotFM®
dot instead of dotFM®

THE dotFM® LOGO
The dotFM® logo must be used as a stand-alone icon to connote origination of dotFM®, without other logos and trademarks associated with it.

Only dotFM® products and services may be used in conjunction with the dotFM®logo.

dotFM® PRODUCT NAMES
No third party logo or mark can be used in conjunction with the dotFM® Marks for dotFM® product names except to connote that dotFM® technology is included with another product or mark. In other words, do not combine the dotFM® Marks with third party trademarks.

The dotFM® Marks and dotFM® logos may not be used as part of the product name for any third party product.

Wherever a dotFM® Mark or dotFM® logo appears with another company trademark or logo, the dotFM® Mark or dotFM® logo must be at least as large as the trademark or logo of the other company.

USING FOOTNOTES FOR CORRECT ATTRIBUTION
It is BRS Media, Inc.’s policy to attribute dotFM® Mark and dotFM® logo use by placing the information in a footnote as follows.

Example:
“_____ are either registered trademarks or trademarks of BRS Media, Inc.”

There is no “boilerplate” footnote. The blank space should be a list of all dotFM® Marks and dotFM® logos that appear in that particular piece. If all dotFM® Marks and dotFM® logos are registered trademarks, then the footnote should indicate as such. Footnotes should always be complete sentences, and ordinarily appear on the copyright page, on the last page of the material.

dotFM is a registered trademark of BRS Media, Inc.
dotFM and dotAM are registered trademarks of BRS Media, Inc.

POWER POINT AND OTHER PRESENTATIONS
dotFM® Marks and dotFM® logos, should always be attributed with the proper symbol and footnoted on all presentations that are displayed to the public (sales, trade shows etc). If a presentation is used internally, the dotFM® Marks and dotFM® logos should be attributed but need not be footnoted.

THIRD PARTY LICENSORS
Some dotFM® products include technology used under license from third party licensors. You may not use any such third party trademark without express permission from the owner.

RESERVATION OF RIGHTS
BRS Media Inc. is the owner of all right, title, and interest in the dotFM® Marks and dotFM® logos. No person or entity may reproduce or use (or authorize the reproduction or use of) the dotFM® Marks or dotFM® logos in any manner other than expressly authorized by BRS Media, Inc. Unauthorized use of dotFM® Marks or dotFM® logos is strictly prohibited.

BRS Media, Inc. may, at its sole discretion, modify the dotFM® Marks or dotFM® logos at any time. Please refer to the dotFM® Mark Chart periodically to ensure your compliance. In order to assure compliance and quality of control, BRS Media Inc. may request that you provide samples of any marketing, advertising, or other material that includes the dotFM® Marks or dotFM® logos.

BRS Media, Inc. reserves the right in its sole discretion to terminate or modify permission to display or use the dotFM (.FM) & dotAM (.AM) Logos and/or Trademarks, and may request that third parties modify or delete any use of the Logo’s and/or Marks that, in BRS Media’s sole judgment, does not comply with these guidelines, or might otherwise impair BRS Media’s rights in the Marks. BRS Media further reserves the right to object to unfair uses or misuses of its trademarks or other violations of applicable law.
